Foundation Protection Notice

This Notice may be served in response to a Notice of Adjacent Excavation. There is no time limit in which there should be a response, since this effectively creates a dispute to be resolved by the Surveyor(s).

A Foundation Protection Notice, should include
  • (a) the name and address of the Adjoining Owner;
  • (b) a requirement that the Building Owner underpin or otherwise strengthen or safeguard the Adjoining Owner's foundations, so far as may be necessary.

 

The Notice should also include
  • (i) the name and address of the Building Owner;
  • (ii) the date of the Notice
  • (iii) the Adjoining Owner's signature
