What you need to consider if intending to build, or excavate, up to 3m from the face of a building, or structure, belonging to another owner, and the depth of excavation would be below the level of that building's, or structure's, foundations.

Your rights

Typical works which require Notice;
  • Constructing foundations;
  • Constructing a basement;
  • Putting in drainage pipework, manholes, gullies;
  • Putting in gas and water, pipework;
  • Laying electricity and communications cables;
  • Forming a soakaway;
  • Excavating trial pits, or soil investigation pits;
  • Removing existing foundations, drainage, basements etc;
  • To underpin or otherwise strengthen or safeguard the foundations of an Adjoining Owner's building or structure as necessary, at your expense.

Excavations within 6m

What you need to consider if intending to build, or excavate, from 3m up to 6m from the face of a building, or structure, belonging to another owner, and the depth of excavation would be below the level of that building's, or structure's, foundations, by more than the same distance.

Your rights

Typical works which require Notice;
  • Piling;
  • Constructing a basement;
  • Removing existing foundations, basements etc;
  • To underpin or otherwise strengthen or safeguard the foundations of an Adjoining Owner's building or structure as necessary, at your expense.

General Obligations

Your obligations for both types of work

Notices
  • To serve a Notice of Adjacent Excavation on each of the Adjoining Owners:-
    • one month before the work is intended to start.
If requested by the Adjoining Owner, to underpin or otherwise strengthen or safeguard the foundations of their building or structure as necessary, at your expense.
To begin the work within the twelve months from the day on which the Notice of Adjacent Excavation was served.
To carry out the work with due diligence.
To give to the Adjoining Owner copies of as-built drawings, including plans and sections, if requested at completion.
